1. Accepting this agreement
These terms form an agreement between you and the operator of Hayati ("Hayati", "we", "us"). By downloading, installing or using the Hayati application or this website, you agree to them. If you do not agree, do not use the service.
2. Eligibility and your account
- You must be at least 18 years old and legally able to enter into this agreement.
- You are responsible for the accuracy of your registration details and for keeping your login credentials confidential.
- One person, one account. Accounts are not transferable and may not be sold, shared or rented.
- You are responsible for activity that happens through your account.
3. Community rules
Hayati is a live, public space. When you use it, you must not:
- Harass, threaten, stalk, defame or discriminate against anyone, or incite others to do so.
- Broadcast sexual content involving minors, non-consensual sexual content, or any content that is illegal in the place you are located.
- Share another person's private information without their permission.
- Impersonate Hayati staff, other users or any third party.
- Promote gambling, drugs, weapons, or fraudulent schemes, or use the service for money laundering.
- Post spam, run advertising, or solicit users to other platforms or services.
- Upload malware, attempt to probe or disrupt our systems, scrape the service, or use automated tools to create accounts or inflate activity.
- Manipulate rankings, gifts, coins or rewards, including through self-dealing or coordinated abuse.
4. Voice, content and licence
You keep ownership of the content you create. To operate the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, transmit, reproduce, display and moderate your content for as long as it is on the service, and for a reasonable period afterwards for backups and legal records. You confirm you have the rights needed to share everything you upload or say in a room.
5. Coins, gifts and purchases
- Coins, gifts and other virtual items are a limited, personal, non-transferable licence to use in-app features. They are not money, do not earn interest, and have no cash value.
- Purchases are processed by the app store or payment provider you use, and their terms also apply.
- Virtual items are non-refundable except where a refund is required by law or by the app store's policy. Coins already spent on gifts are not refundable.
- We may adjust the price, availability or appearance of virtual items, and we may correct balances that result from errors or abuse.
- Where you send a gift, the recipient's balance is credited according to the rules shown in the app.
6. Moderation and enforcement
We may review reported content, mute or remove seats, restrict features, remove content, suspend or close accounts, and remove coins or items obtained through abuse. We may also report unlawful behaviour to the competent authorities. Serious or repeated breaches may lead to permanent closure.
7. Your responsibilities
- Use the service only where it is lawful for you to do so, and comply with local law.
- Do not record or redistribute other people's voices or content without their consent.
- Keep your device, account and payment method secure.
8. Third-party services
The service may link to app stores, payment providers or other third-party services. We do not control those services and are not responsible for their content, terms or privacy practices.
9. Intellectual property
The Hayati name, logo, interface, software and other materials we provide are owned by us or our licensors and are protected by law. These terms do not grant you any right to use our trademarks without our written permission.
10. Availability and disclaimers
The service is provided on an "as available" basis. Rooms are live and depend on networks and devices outside our control, so we do not promise uninterrupted or error-free operation. To the extent permitted by law, we exclude implied warranties, including fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or coins. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or the minimum permitted by applicable law. Nothing in these terms limits liability that cannot lawfully be limited.
12. Suspension and termination
You may stop using the service and delete your account at any time. We may suspend or terminate your access if you breach these terms or if we discontinue the service. On termination, your licence to use virtual items ends. Sections that by their nature should survive termination will continue to apply.
13. Changes to these terms
We may update these terms as the service changes. We will revise the date above and, where the change is material, give notice in the app. Continuing to use the service after an update means you accept the revised terms.
14. Governing law and disputes
These terms are governed by the laws of the country in which the Hayati operator is established, without regard to conflict-of-law rules. Disputes will be brought before the courts of that country, unless the law of your place of residence gives you the right to bring proceedings locally.
